Local fishermen backed by a conservative legal group are going to the US Supreme Court seeking to overturn permits for the “dangerous” 806MW Vineyard offshore wind project, which is already under construction off Massachusetts.
The Texas Public Policy Foundation (TPPF) has filed a petition with the court seeking to overturn a Biden-era appeals court decision that granted the project’s permits.
“The Vineyard Wind 1 project was rushed through and approved despite environmental, safety, and national security risks,” said the legal foundation. “Last July, TPPF’s warnings came true when an enormous windmill blade the size of a football field collapsed into the ocean, scattering fiberglass debris for miles and closing beaches on the east coast.”
“This is a stark example of federal administrative agencies shirking their responsibilities to follow the law,” said Ted Hadzi-Antich, TPPF senior attorney and lead counsel in the case. “When that happens, we are here to hold their feet to the fire.”
TPPF’s case could be buoyed by a Supreme Court ruling in 2024 reversing the 40-year-old ‘Chevron deference’ precedent, which gave federal agencies preference in interpreting complex laws.
A majority of the Supreme Court leans to the right, and President Donald Trump has a vendetta against offshore wind.
