In April the New Jersey Board of Public Utilities (BPU) had refused to approve the 25MW project off the Atlantic City coast, on the basis that its expected energy price of $263 per MWh was too high and should not be borne by state consumers.
In their decision, the judges of the appellate division of the state superior court noted that the wind developer received a $47 million grant from the US Department of Energy, which was announced in May.
They also said that the BPU must acknowledge that Fishermen's application suggests that the project's electricity price will be $199.17/MWh, not the significantly higher $263/MWh price used by the commission in its calculations.
If approved, Fishermen's Atlantic City wind farm would be among the first grid-connected offshore wind projects in the US. It intends to use Chinese 5MW XEMC turbines.
