The 21-turbine wind farm is owned by La Compagnie du Vent and is located in Névian, in the Aude département.
It is not unusual for opponents to appeal against a decision to grant siting permits in France. But this is the first time a case has been brought against a fully permitted and operating plant, built according to the rules and regulations in force.
The judge also awarded damages of €500,000 to the family which brought the case, to compensate for the nuisance caused and the estimated loss in value of their property, which stands 650 meters from the nearest turbine, on the far side of a wooded hill.
The family originally asked for the removal of all 21 Gamesa 850KW turbines, installed eight years ago. La Compagnie du Vent, now majority-owned by energy giant GDF-Suez, has appealed against the ruling.
