Trump administration moves to scrap two claims in Maryland offshore wind farm suit

The US Department of Justice (DOJ) is asking a federal judge to dismiss two of the eight claims brought against the Bureau of Ocean Energy Management (BOEM) over a large wind farm off the coast of Maryland.

The plaintiffs, including the town of Ocean City, argue that BOEM illegally approved US Wind’s 2GW Maryland offshore wind project.

The DOJ is now seeking a partial dismissal of the lawsuit, citing a recent decision in a similar case in Rhode Island involving Ørsted and Skyborn Renewables’ 704MW Revolution Wind project.

On 7 April, a judge in that case dismissed claims related to the Migratory Bird Treaty Act and the Coastal Zone Management Act. Analysts note that the DOJ’s move to defend BOEM in court over the wind farm is somewhat unexpected, given President Donald Trump’s stated opposition to offshore wind development.

BOEM approved the construction and operations plan for the Maryland project in December.
