The preliminary decision, by the Department of Commerce (DoC), is a victory for the US-based Wind Tower Trade Coalition, which filed a complaint in 2011. A final decision on the duties will be announced later this year.
"This is an important step in remedying the harm caused by unfairly traded wind tower exports," says Alan Price of Wiley Rein, whose law firm is handling the case. "We look forward to further relief when [preliminary] anti-dumping duties are announced in about two months."
China and the Asian producers deny the charges.
As soon as the DoC's decision is published in the Federal Register, within three to five days, the US border authorities will require cash deposits to cover the duties on all imported Chinese towers, says DoC spokesman Tim Truman.
The US imported an estimated $222 million of Chinese towers in 2011.
