Speaking to “uåX˜äŠÊ˜·³Ç, Sinovel said: "We will defend ourselves vigorously to safeguard our leading position in independent intellectual properties in the wind-power industry."
On Wednesday, AMSC said it has initiated a series of legal actions against Sinovel for theft of intellectual property and breach of contract. The move stems from Sinovel’s refusal to accept a component shipment from AMSC in April.
In response to AMSC’s move, Sinovel said it had suspended paying AMSC and receiving its components because they did not conform either contractually or with China's grid-access requirements.
Sinovel said: "Before that, we have fulfilled the contract agreements. At the same time, we asked AMSC to improve their technologies, product quality, and carry out service obligations. But after all these years, AMSC has made slow progress in this respect, and failed to honour the agreement."
Sinovel said that since 2006 when AMSC had supplied core electrical components, it had failed to adjust to the rapid development in the global wind power technology market, particularly in China.
Among its claims is the accusation that AMSC frequency converters have high failure rates and that it has failed to rectify the issue. Instead, Sinovel has been left to eliminate the problem itself.
Other accusations include:
- Sinovel’s LVRT technology was developed by its own R&D team.
- AMSC has not fulfilled a contractual obligation to set up an aftersales service team in China.
- AMSC failed to respond to Sinovel’s requests for product replacement and maintanence.
- Sinovel has had to pay for maintenance tasks that were AMSC’s responsibility. Sinovel adds AMSC has refused to reimburse it for these costs.
AMSC was unable to respond to Sinovel's claims.
